Part 2: Terms And Conditions Of Service

Introduction and Acceptance
These Terms and Conditions of Service ("Terms") govern the provision of gas fitting, gas appliance servicing, hot water system service, gas safety inspection and related services by Gas Experts Melbourne, part of the Flowsafe Group ("we", "us", "our"), to customers ("you", "the customer").
By booking a service with Gas Experts Melbourne, you agree to be bound by these Terms. If you do not agree to these Terms, please do not engage our services.
These Terms should be read together with our Privacy Policy above.
Our Services
Gas Experts Melbourne provides gas fitting, gas appliance servicing, gas safety inspection, hot water system service and installation, and related services to residential and light commercial customers across the greater Melbourne metropolitan area.
All gas fitting work is carried out by or under the supervision of persons holding a current gas fitting licence issued by the Victorian Building Authority (VBA) in accordance with the Gas Safety Act 1997 (Vic) and Australian Standard AS/NZS 5601.

Bookings and Appointments
3.1 Booking confirmation
A booking is confirmed when you receive written or verbal confirmation from Gas Experts Melbourne by phone, email or SMS.
3.2 Access to premises
You agree to provide our technicians with safe and reasonable access to the premises and to all gas appliances and fittings requiring service. If access cannot be obtained, we reserve the right to charge a cancellation or attendance fee.
3.3 Cancellation and rescheduling
We ask for reasonable notice if you need to cancel or reschedule an appointment. We reserve the right to charge a fee for late cancellations or where our technician has attended and been unable to gain access to the property.
3.4 Emergency callouts
For emergency gas callouts, we will attend as quickly as practicable. Response times depend on location, time of day and technician availability. We cannot guarantee specific response times for emergency callouts.
Pricing and Payment
4.1 Fixed price quotations
We provide fixed-price quotations before commencing any service or repair work. You will be advised of the full cost of the work before we begin. We will not carry out additional work beyond the quoted scope without your approval.
4.2 No call-out fee
When you book online, there is no call-out fee. For emergency after-hours callouts, a fixed emergency callout rate applies and will be confirmed before we dispatch a technician.
4.3 Payment terms
Payment is due on completion of the work unless a payment plan has been arranged in advance through Brighte or another approved arrangement. We accept credit card (Visa, Mastercard), debit card, EFT and cash.
4.4 Unpaid invoices
Invoices not paid by the due date may be subject to late payment fees and debt recovery action.
4.5 Gst
All prices quoted are inclusive of GST unless stated otherwise. Tax invoices will be issued on completion of work.
Workmanship Guarantee
Gas Experts Melbourne provides a written workmanship guarantee on all labour carried out. All our workmanship is guaranteed and we use quality parts backed by manufacturer warranties. If something is not right after we leave, we will return and fix it.
The guarantee covers defects in workmanship arising from the work we carried out. It does not cover damage caused by misuse, neglect, normal wear and tear of parts, or events outside our control.
Parts and appliances supplied by Gas Experts Melbourne are covered by the relevant manufacturer's warranty.
Certificates of Compliance
Where required under the Gas Safety Act 1997 (Vic), Gas Experts Melbourne will issue a Certificate of Compliance for gas installation work. This certificate confirms the work was carried out by a VBA licensed gas fitter and meets Australian Standards.
Certificates of Compliance are issued for new gas appliance installations, gas pipe installation and modification, and gas system upgrades. A Certificate of Compliance is not issued for routine servicing or repairs that do not constitute installation work under Victorian law.
Rental Property Compliance Reports
Where Gas Experts Melbourne carries out a gas safety inspection for a rental property, we will provide a written compliance report documenting all appliances inspected, test results and findings. This report is provided to assist rental providers in meeting their obligations under the Residential Tenancies Act 1997 (Vic).
Gas Experts Melbourne's report covers gas appliance safety only. The rental provider is responsible for meeting all applicable minimum standards under the Residential Tenancies Act.
Limitations of Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (ACL) that cannot be excluded by agreement.
To the extent permitted by law, our total liability to you for any claim arising from the provision of our services is limited to the cost of the services provided. We are not liable for indirect, consequential or economic loss not directly caused by our negligence.
We are not responsible for pre-existing faults, defects or unsafe conditions in your property or gas appliances that were present before our attendance and were not caused by our work.
Safety and Access Requirements
You agree to provide a safe working environment for our technicians. If our technician determines that it is unsafe to proceed with work due to hazardous conditions, unexpected gas contamination or any other safety concern, they have the right to cease work and advise you in writing of the issue found.
If a gas emergency is identified during a service visit, our technician will advise you immediately, isolate the hazard where safe to do so and recommend immediate remedial action.
Finance Terms
Where payment is made through Brighte Financial Pty Ltd, the terms and conditions of the Brighte finance product apply. Gas Experts Melbourne acts as a referral partner for Brighte and is not a credit provider. We are not responsible for decisions made by Brighte regarding your finance application.

Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. Any dispute arising under these Terms will be subject to the non-exclusive jurisdiction of the courts of Victoria.
Changes to These Terms
We may update these Terms from time to time. The current version will always be available on our website at www.gasexpertsmelbourne.com.au/privacy-policy/.
